FAGOWEES BY-LAWS

(Revised April 2007)

1. Meetings shall be held on the 1st and 3rd Tuesday of the month at a time and location designated by the Executive Committee. The admittance fees to the general club meetings for members, guests and Executive Committee members will be determined by the Executive Committee.

2. Meetings will be run by the President or a member so designated by the President after reviewing a pecking order: Vice President, Membership Chairman, Social Chairman (of the season), Treasurer, Secretary, Race Chairman, Trustees.

3. The results of the vote counts of a general election will be available to members upon request.

4. Minutes of the Executive Committee meetings will be available from the Secretary upon request.

5. Executive Committee meeting will be open to the general membership at the discretion of the President.

6. Members of the Executive Committee will have only one vote regardless of the number of voting offices that they hold on the Executive Committee. Co-chairmen will have voting rights in the absence of the Chairman of the particular committee. Committees are: Membership, Social, Publications, and Race.

7. International Fagowee of the Year, Rookie of the Year, and Fagowee of the Month shall be chosen by the Trustees. Racer of the Year shall be chosen by the Race Committee.

8. A record of Fagowee equipment will be maintained by the Auditor and will be available to the Executive Committee at all times. Auditor may appoint a person to store and maintain all Fagowee equipment subject to approval by the Trustees. Auditor will have ultimate responsibility for all equipment.

9. New members rates will be $35.00 for individuals and $40.00 for married couples from October 1 to May 31. After June 1, rates will be based on a prorated schedule prepared by the Membership Committee and voted on by the Executive Committee. Out of State members are $25.00 for individuals and $30.00 for couples. Out of state price does not include name tags. New limited members will pay $15.00 less then the above rates, unless out of state, where $10 less applies. If the limited member shares a permanent address with an immediate family member who is a full FAGOWEE member, the limited member will get an additional $10 off their membership fees and only 1 Happening will be sent to that shared address.

10. Renewals will be $25.00 for individuals until October 31. Renewals for married couples will be $30.00 until October 31. Out of state renewals will be $20.00 for individuals and $25.00 for couples. Renewing limited members will pay $10.00 less then the above rates, unless out of state, where $5 less applies. If the limited member shares a permanent address with an immediate family member who is a full FAGOWEE member, the limited member will get an additional $5 off their membership fees and only 1 Happening will be sent to that shared address. Out of state renewal prices do not include name tags. Renewal/membership application cards are to be included in the September issue of The Happening.

11. Name tags will be replaced at current prices.

12. A member, or limited member cannot be put on probation or expelled from the club until he or she receives a written notice from the Executive Committee to that effect. See current "Responsibility Code" and Constitution for reasons and details. A Limited member can be considered for dismissal from the club for any Class A or Class B violation.

13. The Fagowee name cannot be used for any purpose unless approved of by the Executive Committee.

14. The Fagowee Directory cannot be used for any business purposes.

15. When a published Fagowee function and another Fagowee function conflict, the Executive Committee must approve of the conflicting event before such event can be announced or publicized (via Fagowee newsletter, phone, flyers at meetings, or announced at meetings.) There will be no solicitation, advertisement or money collection of non-Fagowee events, conflicting or otherwise, to take place at the general meetings or at Fagowee sponsored events, without the approval of the President or a Trustee.

16. The Social Chairmen appoint trip leaders (subject to Trustee approval). After approval of the trip by the Executive Committee the trip may be announced.

17. One free trip will be given to the trip leader to be used on the trip at his or her discretion. Any modifications to the one free trip rule for a trip leader will require a separate vote of the Executive Committee, in addition to any trip approval vote.

18. The guest assessment will be determined by each trip leader and must be stated at the time the Executive Committee approves the trip.

19. Payment in full will be required for all trips up to $25.00. A minimum deposit of 25% will be required for all trips over $25.00. Trips must be paid in full at least two (2) weeks prior to departure - subject to individual trip restrictions.

Trip Leaders must establish a date, based on contractual obligations of the club, whereby any trip applicant notifying the Trip Leader of cancellation before such date will receive a full refund – known as the “100% refund date”. Trip applicants notifying the Trip Leader of cancellation after the 100% refund date will be responsible for non-recoverable costs (caused by the trip applicant canceling from the trip) incurred by the club in determining any refund amounts. It is incumbent upon the Trip Leader to recover costs, if possible.

Refunds for cancellations before the 100% refund date will be paid as soon as practical. Refunds for cancellations after the 100% refund date will be paid after the final trip report has been completed by the Trip Leader and reviewed and approved by the Auditor or Treasurer, and applicable Social Chairman.

All trips costing $25.00 or more should clearly state the cancellation policy and 100% refund date on the trip agreement and in all trip advertisements. Trips over $25.00 must have a trip agreement signed by each trip applicant.

20. Should a trip make excessive surplus after the refund policy has been applied, the Trip Leader may come before the Executive Committee (after the trip report is filled out) and make a request for a certain dollar refund allowance per trip applicant. The Executive Committee must approve the refund before it will be issued.

21. Should a trip be cancelled by the club, full refunds will be made to each trip applicant. The President shall make the final decision to cancel a trip in consultation with the trip leader and applicable Social Chairman.

22. A "rejection list" will be made and held by the Treasurer of the Fagowees of members owing money to the club and not cleared 30 days after the debt is made. These people will be advised in writing by the Auditor that they will not be allowed to write checks to the Fagowees, run or hold office in the Fagowees, or to run Fagowee sponsored trips until six (6) months after the debt is cleared. Anyone who bounces a check will not be allowed to participate in any Fagowee sponsored event until their debt is cleared. Second offenders will not be permitted to write checks to Fagowees and will be on a cash basis until review. The CASH ONLY list will be the responsibility of the Treasurer who will notify the Social Chairmen and people responsible for any Fagowee funds.

23. The Fagowee fiscal year will run from June 1 to May 31.

24. Elections - Trustees or outgoing officers not running for office may be called upon to help the Election Committee on Election Night.

25. The immediate Past-President shall be a member of the Executive Committee for one (1) year as an advisor.

26. Nominees for Ski Queen must have been in the club for at least one year. Term runs concurrent with Fagowee fiscal year, June 1 to May 31. Nominations for Ski Queen will be taken in March and Ski Queen Elections will be at the first meeting in April.

27. Racing credits are at the discretion of the Club. Race credits will be applied based on the number of races paid for and raced in the PREVIOUS year. Credits shall be applied toward race fees ONLY. If credits are not used in that year, they are forfeited. Credits will be made available by the Race Chairman at least one (1) week prior to the first race of the season. Unless, any Fagowee racer, who, through the participation in races of the previous season, accumulates race credits and is unable to use those credits in the following season due to pregnancy or debilitating injury, shall have the option of assigning to another Fagowee racer his or her earned credits. This transfer of race credits, once assigned and approved by the Race Chairperson for the upcoming season, can not be carried forward to another race season, re-assigned in any other fashion, or be reverted back to their original possessor. A request of such transfer must be made in writing, delivered to, and approved by the Race Chairperson PRIOR to the first race of the upcoming season.

28. All club trips will be considered adult only (21 and over), unless the Executive Board approves the trip open to limited members or declares the event 'family friendly' (open to all ages). Further the trip ad must say: "Open to Limited Members" or "Family Friendly". If it does not the trip is automatically considered to be 'Adult Only'. If the trip is labeled 'Open to Limited Members', limited members can participate and only guests over 21 can sign up the trip. If a trip is labeled 'Family Friendly' limited members may sign up and guests under 21 may attend subject to age limitations set by the trip leader, and approved by the Executive Board.
